China Compliance Alert: Baiyin City Bans Illegal Additives in Fresh Produce and Offers Whistleblower Rewards
Foreign founders operating food, agriculture, cold-chain or logistics businesses in China should note Baiyin City's new notice on illegal additives in edible agricultural products, which sets strict bans across the supply chain, escalating penalties and a tiered whistleblower reward scheme.
Why This Notice Matters for Foreign Founders
Foreign founders building food processing, fresh produce trading, cold-chain logistics or agricultural sourcing operations in China should treat local food-safety enforcement notices as operational compliance documents, not background reading. A notice issued by the Baiyin City Food Safety Committee Office, the Baiyin City Agriculture and Rural Affairs Bureau and the Baiyin City Market Supervision Administration sets out prohibited practices across the edible agricultural product supply chain, links violations to national food safety, agricultural product quality safety and criminal law, and introduces a paid whistleblower program. The rules apply to producers, buyers, storage operators, transporters and market managers, which means foreign-invested entities active in these segments may fall within scope.
What the Notice Prohibits
Farming and Breeding Stage
Operators may not use nationally banned or restricted pesticides, banned or suspended veterinary drugs, or other substances that may harm human health in the cultivation or breeding of vegetables, fruit, goji berries and livestock and poultry products. Pesticide pre-harvest intervals and veterinary drug withdrawal periods must be observed, and agricultural inputs may not be used beyond approved scope or limits.
Post-Harvest Handling
For fresh produce including cabbage, lettuce, cucumber, bean sprouts, mushrooms and fruit, the notice bans soaking, dyeing or fumigating with non-food substances such as formaldehyde, industrial sulfur, sodium formaldehyde sulfoxylate, and the colorants guolv, brilliant blue and tartrazine. Preservatives, anti-corrosion agents and colorants that lack production licenses, lawful origin or labels — so-called "three-no" products — are also prohibited.
Purchasing and Storage
Buyers, agents and cold-storage operators may not carry out unlawful operations during sorting, washing, preservation or packaging. Adulteration and addition of non-food substances are banned. Preservation warehouses and pre-cooling facilities may not use prohibited preservatives or industrial refrigerants, and facilities with substandard internal environments may not continue operating.
Transportation
Edible agricultural products may not be shipped together with toxic or harmful goods. Ordinary trucks that do not meet statutory food storage and transport requirements may not carry products requiring temperature control. Non-food chemicals with preservative or freshness-retention functions may not be used during transport, and vehicles must be cleaned and disinfected with complete packaging labels so traceability is not broken.
Sales and Market Management
Forging or misusing green, organic or geographical indication quality marks and false advertising are prohibited. Operators of wholesale, farmers' and convenience markets must perform entry inspection duties, check and collect commitment certificates of compliance, retain purchase vouchers as required, and publicly disclose food safety information.
Enforcement and Criminal Referral
Violations are to be punished strictly under the Food Safety Law and the Agricultural Product Quality Safety Law. Suspected criminal conduct is to be referred to public security authorities for criminal liability. For foreign founders, this signals that food-safety breaches in China can escalate beyond administrative fines into criminal exposure for responsible individuals and entities.
Whistleblower Reward Scheme
Baiyin City offers rewards under the Gansu Province Food Safety Reporting Reward Measures to encourage public reporting of illegal additives in edible agricultural products.
- Tier 1: Detailed facts and direct evidence fully matching the violation, verified as an especially major violation — generally 5% of fines and confiscations, with a minimum of RMB 2,000.
- Tier 2: Facts and direct evidence fully matching the violation — generally 3%, minimum RMB 1,000.
- Tier 3: Basic facts and relevant evidence broadly matching the violation — generally 1%, minimum RMB 500.
- Where penalties involve no fine or confiscation, Tier 1 to Tier 3 rewards are no less than RMB 2,000, RMB 1,000 and RMB 500 respectively.
- Where a court judgment confirms criminal liability, rewards are 5%, 3% and 1% of the fine amount; if no fine is imposed or the calculated amount is below RMB 30,000, RMB 30,000 is awarded. Rewards per criminal case generally do not exceed RMB 500,000. If a defendant is exempted from criminal punishment, the reporter receives RMB 30,000.
- Reports by internal personnel from production, operation or use links, as recognized by food safety authorities, may be calculated at twice the reward amount.
Reporter Protection and Channels
Reporter identities are to be kept strictly confidential, retaliation is to be punished severely, and both named and anonymous reports are permitted; anonymous claimants must provide identifying information as an identity code. Reports can be made via the 12315 complaint hotline or 12345 government service hotline, or in writing to local market supervision offices or the agriculture and rural affairs bureau. Rewards are administered by the authority that made the handling decision after verification and a lawful decision, with funds paid promptly to eligible reporters.
Practical Takeaways for Foreign Founders
Map every stage of your China supply chain against the five prohibited categories, verify supplier licenses and labels, document temperature-controlled transport and warehouse conditions, and ensure market-entry inspection and traceability records are complete. Internal compliance hotlines and supplier audits reduce the risk that a whistleblower report — potentially rewarded at up to double the standard amount for insiders — triggers enforcement. Because the notice rests on national laws and a provincial reward measure, similar expectations may appear elsewhere in China.
